We just received the following notice and we thought it was so good it should be distributed more widely.  We do so with the permission  of the Joint Landowners Coalition of New York (JLCNY), the lead organization protecting landowner mineral rights in New York State .

Recent decisions by the New York State Supreme Court have left residents in Dryden and Middlefield void of private property rights. This is only the beginning if these duplicitous rulings remain unchecked. Fortunately, examinations of each decision have opened the door for separate appeals.

At the New York State Appellate Court, rulings will be  free of local political pressures. Here only the facts, history, and proper case law will determine the outcome. If successful, the property rights in Dryden and Middlefield will be restored moving New York State one step closer to Marcellus shale development.

Perhaps an even more important outcome from such a reversal, is the consequence on the agenda driven Park Foundation funded CDC lawyers David and Helen Slottje. Still  (paid mind you) to roam the New York countryside in order to mislead municipalities down a road to socialism and pastoral poverty.

Dear Friends, Coalition Leaders, Landowners, and Natural Gas Supporters,

I have even more great news to share with you!

The first item is about the two lawsuits against towns that are attempting to stop natural gas development efforts. While it was unfortunate that the Supreme Court judges ruled as they did, efforts will soon be underway in an attempt to protect our rights and interests. More specifically…

The notice of appeal and related papers were transmitted for filing and served Thursday to appeal the Dryden decision. A motion to renew in the Middlefield case to bring newly discovered records concerning the legislative history of the supersedure provision before Judge Cerio was also transmitted Thursday. The notice of appeal and related papers to appeal the Middlefield decision will be served Friday.

The second item is an information meeting announcement. This is great news because the speakers will be presenting information not presented in the media about town bans, Development technology, economics, and the Environment, How Ad Valorem will help your entire community, and more. These are all topics of immediate concern, and the facts to be presented will defeat the lies and misinformation so commonly heard. You’ll want to hear this and help spread it once you hear it.

In addition, there will be fundraising efforts to help fellow landowner and farmer Jennifer Hunnington appeal her lawsuit against the town of Middlefield. Without funds her appeal will die and the chance to have our landowners’ rights defended will die right alongside it. With funds the appeal can proceed to the Appellate level where we fully expect to prevail and reaffirm our rights as landowners. The JLCNY will be donating $1000.00 to kick off the fundraising that will be so important for Jennifer’s appeal and all of our futures. We encourage everyone to kick in a few dollars as well.
